1. Acceptance of Terms

By downloading, installing, or using ScrollShots (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

ScrollShots is a mobile application that uses artificial intelligence to generate carousel slide content from text you provide. The App allows you to create, edit, customize, and export carousel slides as PNG images or PDF documents.

3. Account Registration

To use the App's generation features, you must create an account via Apple Sign-In, Google Sign-In, or email/password. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. AI-Generated Content

• Content is AI-generated: Carousel slides created by the App are generated by artificial intelligence based on your input. AI-generated content may contain inaccuracies, errors, or biases.
• Your responsibility: You are solely responsible for reviewing, verifying, and editing all AI-generated content before sharing or publishing. You assume full responsibility for any content you distribute.
• No guarantees: We do not guarantee that AI-generated content is accurate, original, free from copyright issues, or suitable for any particular purpose.
• Content ownership: You own the carousel content you create and edit within the App. We do not claim ownership of your content. However, you grant us a limited license to process your input text through our AI systems for the purpose of generating your content.

5. Content Policy

You agree not to use ScrollShots to generate, distribute, or share content that:

• Is sexually explicit, pornographic, or obscene.
• Promotes violence, terrorism, self-harm, or harm to others.
• Contains hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Exploits, harms, or endangers minors in any way.
• Is defamatory, harassing, threatening, or invasive of another's privacy.
• Infringes on intellectual property rights of others.
• Impersonates real individuals without their consent.
• Promotes illegal activities, fraud, or deception.
• Contains malware, phishing content, or other harmful material.

We implement automated content moderation filters to prevent generation of prohibited content. We reserve the right to refuse service, terminate accounts, and report illegal content to authorities. Users can report problematic content using the in-app report feature.

6. Subscriptions and Payments

• Free tier: Includes up to 4 AI generations per day, PNG export, and standard templates. Free exports include a ScrollShots watermark.
• Pro subscription: Offers up to 50 generations per day, enhanced AI quality, PDF export, no watermark, AI-generated backgrounds, premium templates, cloud sync, and priority processing.
• Billing: Subscriptions are billed through Apple App Store or Google Play. Prices are displayed in the App and may vary by region.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel at any time through your device's subscription settings (Apple: Settings > Apple ID > Subscriptions; Android: Play Store > Subscriptions). Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose.
• Attempt to reverse engineer, decompile, or modify the App.
• Interfere with the App's functionality, servers, or networks.
• Circumvent rate limits, content filters, or other security measures.
• Create multiple accounts to bypass usage limits.
• Use automated tools or bots to interact with the App.
• Resell, redistribute, or sublicense access to the App or its features.

8. Intellectual Property

The App, its design, code, branding, templates, and original content are owned by SM SEAMLESS DIGITAL LTD and protected by copyright and trademark laws. You may not reproduce or distribute any part of the App without our written permission.

9. Termination

We may suspend or terminate your account and access to the App at our discretion if you violate these Terms, abuse the service, or engage in prohibited conduct. You may delete your account at any time through the App's Settings.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The App will be available at all times without interruption.
• AI-generated content will be accurate, complete, or error-free.
• The App will meet your specific requirements.

11. Limitation of Liability

To the fullest extent permitted by applicable law, SM SEAMLESS DIGITAL LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages arising from AI-generated content you share or publish.

12. Indemnification

You agree to indemnify and hold harmless SM SEAMLESS DIGITAL LTD from any claims, damages, losses, or expenses arising from your use of the App, content you create or share, or your violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Cyprus and applicable European Union laws. Any disputes shall be resolved in the courts of Cyprus.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. Significant changes will be notified in-app.
